National Pollution Discharge Elimination System (NPDES)
In the year 2000, US EPA delegated the NPDES program to the State of Florida for implementation. The program regulates point source discharges of storm water runoff from certain construction sites and was developed in two phases:
- Phase I- regulates large construction activity (over 5 acres);
- Phase II- regulates small construction activity (over 1 acre).

Generic Permit for Storm water Discharge from Large and Small Construction Activities (CGP) (DEP Document 62-621.300 (4) (a), F.A.C requires:
- Notice of Intent (NOI) – DEP form 62-621.300 (4) (b) along with fee submitted to DEP 48 hours before construction starts.
- A SWP3 must be developed and implemented to include the following:
- A site evaluation of how and where pollutants may be mobilized by storm water;
- A site plan for managing storm water runoff;
- Identification of erosion and sedimentation controls and BMPs to reduce erosion, sedimentation, and storm water pollution;
- A maintenance and inspection schedule (Phase I = weekly or after 0.25 inches of rain, Phase II= weekly or after 0.50 inches of rain);
- A recordkeeping process (must document inspections, maintenance, changes and retain for 3 years); and
- Identification of storm water exit areas.
Notice of Termination (NOT) - DEP Form 62.621.300 (6) must be submitted within 14 days after fully stabilized.
